Data Privacy Statement

Objective and Responsibility

  1. This Data Privacy Statement provides you with information about the nature, scope and purpose of personal data processing in relation to our online service and related websites, features and contents (hereafter collectively referred to as 'online service' or 'website').
  2. The online service is provided by VIER PFOTEN International, Linke Wienzeile 236, A-1150 Vienna, Austria (hereafter referred to as 'provider', 'we' or 'us'), which is legally responsible under the data protection law.
  3. Our online service is hosted by DATAplexx IT- und Telekommunikationslösungen GmbH, Hosnedlgasse 16A, A–1220 Vienna, Austria, and is maintained by web&co, Marxergasse 5/24, A-1030 Vienna, Austria.

  5. The term 'user' encompasses all clients and visitors to our online service.

 

Legal Basis

We collect and process personal data based on the following legal grounds:

  1. Consent in accordance with Article 6, paragraph 1 (a), General Data Protection Regulation (GDPR). Consent is understood as a voluntary, informed and unambiguous declaration of intention in relation to a specific case, given in the form of a statement or any other unambiguous act of confirmation with which the person concerned indicates agreement to the processing of his or her personal data.
  2. Necessity for the performance of a contract or for preparatory steps according to Article 6, paragraph 1 (b), GDPR, i.e. when the data is required in order for us to fulfil our contractual obligations towards you or to prepare the conclusion of a contract with you.
  3. Processing in order to comply with a legal obligation in accordance with Article 6, paragraph 1 (c), GDPR, e.g. when the processing of data is required by law or other provisions.
  4. Processing in order to protect legitimate interests in accordance with Article 6, paragraph 1 (f), GDPR, i.e. when processing is necessary to protect our legitimate interests or those of a third party, in so far as such interests are not overridden by fundamental rights and freedoms protecting your personal data.

 

Rights of Data Subjects

We guarantee the following rights when processing your data:

  1. The right to lodge a complaint with a supervisory authority in accordance with Article 13, paragraph 2 (d), GDPR, and Article 14, paragraph 2 (e), GDPR.
  2. Right of access in accordance with Article 15, GDPR.
  3. Right to rectification in accordance with Article 16, GDPR.
  4. Right to erasure ('right to be forgotten') in accordance with Article 17, GDPR.
  5. Right to restriction of processing in accordance with Article 18, GDPR.
  6. Right to data portability in accordance with Article 20, GDPR.
  7. Right to object in accordance with Article 21, GDPR.

Note: Users may object to the processing of their personal data in accordance with legal provisions at any time and with future effect. In particular, objection may be directed against processing for the purposes of direct marketing.

Notwithstanding other administrative or judicial remedies, you have the right to complain to a supervisory authority, in particular in the Member State of your place of residence, employment or of the alleged infringement, if you believe that the processing of your personal data violates the GDPR.

 

Erasure of Data and Archiving Obligations

Your personal data will be erased or blocked as soon as the purpose of its storage becomes redundant. Storage of data beyond this may occur if required by the European or national legislator in EU regulations, laws or other regulations to which we are subject. Blocking or erasure of data will also take place with the expiry of the mandatory retention period set by the mentioned standards, unless the continued storage of data is required for the conclusion of a contract or the fulfilment of contractual obligations.

 

Security of Data Proccessing

  1. We have implemented appropriate technical and organisational security measures (TOMs) in line with the newest technical standards. Thus, data processed by us is protected against accidental or intentional manipulation, loss, destruction and unauthorised access.
  2. These security measures include, in particular, the encrypted transfer of data between your browser and our server.

 

Transfer of Data to Third Parties, Subcontractors and Third Party Providers

  1. A transfer of personal data to third parties will only occur within the framework of legal requirements. We only disclose the personal data of users to third parties if this is required e.g. for billing or other purposes, or if its disclosure is necessary to ensure the fulfilment of contractual obligations towards users.
  2. Should we engage subcontractors for our online service, we will have made appropriate contractual arrangements with these companies and taken adequate technical and organisational measures.
  3. Should we use content, tools or other resources from other companies (hereafter collectively referred to as 'third party providers') whose registered offices are located in a third country, it must be assumed that data transfer to the home countries of such third party providers will occur. We will only undertake the transfer of personal data to third countries if an adequate level of data protection, your consent, or another form of legal permission, is available.

 

Concrete Data Processing

Donations

  1. Should you donate to us online, we will collect data about the donation (e.g. amount, donation interval and method of payment), as well as basic personal data and contact data (e.g. name, e-mail address and telephone number).
  2. During the donation process, all data will be sent using SSL encryption, so that it cannot be intercepted by unauthorised parties.
  3. Your data will be treated as strictly confidential and will not be passed on to third parties.

Sponsorship

  1. Should you become an online sponsor, we will collect your sponsorship data (e.g. amount, payment interval and method of payment), as well as basic personal data and contact data (e.g. name, e-mail address and telephone number).
  2. During the donation process, all data will be sent using SSL encryption, so that it cannot be intercepted by unauthorised parties.
  3. Your data will be treated as strictly confidential and will not be passed on to third parties.

Collection of Access Data

When using our online service, information may be transferred automatically from your browser  to us. This information includes the name of the accessed website, file, date and time of access, amount of data transferred, notification of successful access, information on your browser type and version, the operating system, referrer URL (the previously visited page), IP address and the requesting provider.

  1. This information is processed for the purposes our legitimate interests in accordance with Article 6, paragraph 1 (f), GDPR (e.g. in order to optimise the online service), as well as to ensure the security of processing in accordance with Article 5, paragraph 1 (f), GDPR (e.g. in order to repel and identify cyberattacks).
  2. This information will be automatically deleted 30 days after the termination of the connection, unless another retention period demands otherwise.
  3. The collection and storage of data in log files is essential for the provision of the online service. As the user, you are not entitled to erasure, objection and correction options.

 

Contact Form and Contact via E-mail

  1. When contacting us (via online form or e-mail), the data you provide will be processed exclusively for processing and handling the inquiry.
  2. Any other use of your data will only take place with your consent. 
  3. Your data will be stored in our Customer Relationship Management System ('CRM System') or in comparable software or a comparable database. The legal retention periods for business correspondence apply.

 

Newsletter

The following sections explain the contents of our newsletter as well as the registration, dispatch and statistical analysis processes, and your rights of revocation. By subscribing to our newsletter, you consent to receipt of the newsletter and to the processes outlined below.

1. Double opt-in and logging

Registering for our newsletter involves a so-called double opt-in process. This means you will receive an e-mail after registration asking you to confirm your registration. This confirmation is necessary to prevent people from registering from another person's e-mail account. The newsletter registrations are logged so that evidence of the registration process can be produced in accordance with legal obligations. These records include the times of registration and confirmation, as well as the IP address.

2. Dispatch service provider

The newsletter is sent out by our subcontractor Growing Minds, Wibautstraat 135-139, 1097 DN Amsterdam (hereafter referred to as 'dispatch service provider'). The dispatch service provider's  data privacy policy can be viewed here: https://www.cleverreach.com/de/datensicherheit/.

According to its policy, the dispatch service provider can use this data in pseudonymous form, i.e. without allocation to a user, in order to optimise or improve its own services, e.g. to technically optimise the dispatch process and presentation of the newsletter or for statistical purposes to determine which countries the recipients are based in. However, the dispatch service provider will not use the details of our newsletter recipients to communicate with them directly or to share them with third parties.

3. Registration data

In order to register for our newsletter, you must enter your e-mail address, your academic or professional title, first name, surname and country of residence.

4. Statistical survey and analysis

The newsletters contain a so-called 'web beacon', i.e. a pixel-sized file which is accessed by the dispatch service provider's server when the newsletter is opened. When accessed, technical information such as information about the browser and your system, as well as your IP address and the time at which it is accessed, is logged. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour, the places from which it is accessed (determined with the aid of the IP address) or the times at which it is accessed. 

The statistics logged also include details determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be attributed to individual newsletter recipients. However, it is not our intention, nor that of the dispatch service provider, to monitor individual users. Rather, analysis allows us to identify the reading habits of our users and to adapt our contents accordingly or to send different contents based on our users' interests.

5. Legal basis

The use of the dispatch service provider, the conducting of statistical surveys and analysis as well as the logging of the registration process is based on our legitimate interests in accordance with Article 6 (1) (f), GDPR. We are interested in the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of our users.

6. Termination/Revocation

You may cancel the receipt of our newsletter at any time, i.e. revoke your consent. You will find a link where you can cancel the newsletter at the end of each newsletter. If you cancel the newsletter subscription, your personal data processed for the dispatch of the newsletter will be deleted.

 

Google Tag Manager

  1. This website uses the Google Tag Manager. This service allows website tags to be managed through an interface. The Google Tool Manager only implements tags, does not set cookies and does not collect any personal data. The Google Tag Manager triggers other tags that may collect personal information. However, the Google Tag Manager does not access this data.
  2. If deactivated at domain or cookie level, it will remain valid for all tracking tags implemented with Google Tag Manager.

 

Facebook Connect

  1. If a so-called 'Facebook Connect Button' is placed on this website, you will have the possibility to log in to our website with your Facebook user data. In addition, Facebook Connect can automatically include information about your activities on our website in your Facebook profile. Thus, when you activate the button, you will be given the opportunity to expressly consent to your Facebook user data being accessed as well as to the publishing of information and activities in your Facebook profile. The use of further data (e.g. contact via your e-mail address) will only take place with prior express consent.
  2. Please note that Facebook receives information about the application or website via Facebook Connect, including about your activities. In order to personalise the connection process, Facebook may in some cases receive a limited amount of information prior to authorising the application or website.

Google Analytics

  1. Our online service uses Google Analytics, a web analysis service provided by Google Inc. ('Google').
  2. Google Analytics uses 'cookies' – text files placed on your computer – to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, Google will shorten your IP address in Member States of the European Union or in other states party to the Agreement on the European Economic Area beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services relating to website and Internet use. The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.   1. This website uses the remarketing or 'similar target group' tool offered by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ('Google').
  2. You can be targeted with advertising through the placement of personalised and interest-based ads when you visit other websites in the so-called 'Google Display Network'. 'Google Remarketing' or the 'similar target groups' tool uses so-called 'cookies', text files which are stored on your computer and enable the analysis of your use of the website. Google AdWords Conversion Tracking

  1. This website uses the 'Google AdWords Conversion Tracking' tool offered by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ('Google').
  2. Google AdWords Conversion Tracking uses 'cookies' – text files placed on your computer – to help the website analyse how users use the site when they click on a Google ad. The cookies are valid for a maximum of 90 days. Personal data will not be stored. As long as the cookie is valid, Google and we as website operators can see that you clicked on an ad and reached a specific target page (e.g. order confirmation page, newsletter registration). Google Web Fonts

In order to ensure that fonts used on this website are uniform, this website uses so-called 'Web Fonts' provided by Google. When you access a page on our website, your browser will load the required web fonts into your browser cache to correctly display text and fonts.

YouTube

  1. We use YouTube for the integration of videos. The videos have been embedded in the extended data protection mode.

  3. When using YouTube, a connection is established with the Google DoubleClick network. Starting the video can trigger further data processing. We have no influence on this.

DoubleClick

  1. Doubleclick by Google is a service offered by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ('Google').
